Terms and Conditions
1. Legal Scope
The offers provided by the Internet
platform www.pokerstrategy.com (referred to as "platform" in the following text) are made through the
provider visible in the imprint (referred to as „PokerStrategy") exclusively
under consideration of the following terms and conditions. These apply to every
user who registers for the content, offers and services the platform provides.
Through registration, the user formally accepts these general terms and
conditions.
2. Use
of the services
2.1 To register on the platform the user has to be at least 18 years old.
2.2 Following successful registration on the platform, the user is
authorized to make use of all offers and services of the platform, free of
charge. PokerStrategy is not obligated to provide particular content or
services.
2.3 In addition to the complimentary use
of the offers, through the platform the user is given the option to register
for poker game platforms, which are not operated by PokerStrategy. These poker
game platforms can in cases of referral provide the user with a Startbonus.
PokerStrategy can make such a referral conditional - e.g. through fulfilling
the requirements of a quiz.
2.4 The transfer of the answers of the
quiz to third parties is not allowed and can cause the exclusion of the user
according to clause 4.
2.5 In order to avoid any disadvantage
for other users, the user registered at PokerStrategy may create only one
account on each of these poker game platforms and receive the Startbonus only once.
Multiple registrations at PokerStrategy or at one of these poker game platforms
through PokerStrategy is prohibited and will lead to the withholding/reversal
of the Startbonus, as well as exclusion of the user, according to clause 4.
2.6 The Startbonus can be withdrawn by
the poker game platforms according to their respective terms and conditions
from the account of the user held at their respective poker game platform -
e.g. if the user does not begin using their Startbonus after three months of
receipt. In case of a withdrawal of the Startbonus, if the balance falls below US$50,
only the balance will be withdrawn. In no case will the user have to pay the
difference.
2.7 The possibility for cashing out the
Startbonus as well as the earnings won is based upon the terms and conditions
of the respective poker game platforms. Payments are made exclusively by the
poker game platforms themselves. PokerStrategy is not obligated to respond to
any payment claims made by the user.
3. Data
Protection
3.1
Declaration of
consent
The user accepts that
PokerStrategy may save any personal data provided during registration in
electronic form. The personal data of the user will be handled with utmost care and in adherence to the laws and ordinances of data protection.
3.2 Data Verification
PokerStrategy verifies
user data for validity. PokerStrategy reserves the right to carry out random
checks as well as the right to ask users for a proof of identity, e.g. in the
form of a copy of a driver's license, ID card or passport. This is intended to
avoid misuse and any associated disadvantages caused towards other users.
3.3 Purpose of saved data
PokerStrategy uses saved data for
accounting purposes in the Tell-a-Friend program, as well as preventing misuse
by the user.
3.4 Deletion of Data
PokerStrategy stores user data for
as long as the agreement by contract specifies (for example within the
Tell-a-Friend program). During this storage period, the user data is
inaccessible. After expiration of this period, the user data is deleted.
4. Exclusion of users/Cancellation
PokerStrategy reserves the right to exclude
users from the platform, through registration cancellation and by blocking a
new registration. PokerStrategy will exclude users particularly in the case of
a user making false statements during registration or attempting to create more
than one account at PokerStrategy or any related poker game platform.
PokerStrategy reserves the right to exclude users based on other reasons e.g.
sharing the answers of the quiz with third parties, breaching the general terms
and conditions or in the case of any evidence that the user has acted in
another illegal manner. The user will receive notification
of successful registration via e-mail. Cancellation of the contract will be
communicated in the same way.
5. Individual
Password
After successful
registration is completed, the user will receive an individual password which
can be changed. Access to the boards at PokerStrategy is only possible with
this password. The user may not reveal this password to any third party and
must keep it safe in order to prevent misuse.
6. Concession
of the Right of Use/User Liability
6.1 Should a user publish content that is copyrighted or under legal
protection in any other way (text and/or images) on the platform - e.g. by
publishing them in the boards, tip sections, news or comments, etc - he/she
allows PokerStrategy to store and publish this content on the platform in any
frequency, at any time or place, making at publicly accessible and held ready
for retrieval by a third party, free of charge. This content (text,
images, etc.) will be published only on the platform it was sent to or was
loaded onto. Usage for advertising
purposes is allowed only after consultation with the former author and after
receiving their authorization.
6.2 Furthermore, through their contributions, the user assures that he/she
possesses the legal rights of the content posted, and has not assumed them in
any other way. PokerStrategy is not obligated to verify the validity,
completeness and legality of user contributions, particularly in the community
area.
6.3 In addition to this, the user assures that any uploaded, saved or
linked content that is presented or published and thus made publicly accessible
- should they refer to other platforms - that the content of these platforms:
- Does not contain any
external, anti- or comparative advertising
- Does not contain viruses,
fraudulent content, trojans or unsolicited mass mailings (so called „spam") in
any way
- Does not defy the
following:
*The rights of third
parties
*Legal and official
prohibitions
* Internet manners and
code of conduct (Netiquette, Chatiquette) or
* Does not contain
content perceived as obscene, insulting, defaming, defamatory, pornographic,
not fit for minors, racist, xenophobic, or condemnable in any other way.
6.4 The
user is liable for all damage caused to PokerStrategy as a result of violation
of the above listed conditions.
7. Deletion
of Contributions
PokerStrategy and their
administrators are authorized to delete content either written and/or posted by
users e.g. articles, posts or segments, particularly if a violation of the
conditions listed in clause 6.2 and 6.3 occurs. Furthermore, PokerStrategy
reserves the right to cancel content which does not defy internet manners and
code of conduct. In particularly serious cases, PokerStrategy reserves the
right to exclude the user according to clause 4.
8. Liabilities
of PokerStrategy
The liability of
PokerStrategy for damage caused through the use of offers provided, e.g.
through downloading, installation and use of programs and data files, is limited
to intent or gross negligence. It is the responsibility of the user to
independently check data for viruses and suchlike.
9. Disclaimer
If the Platform refers
you to secondary website, the respective operator/authors of that platform are
responsible for their own content. PokerStrategy is not responsible for, nor
has any impact on the contents of pages it may link to. PokerStrategy clearly dissociates itself from
any illegal, personally harmful, morally or ethically immoral or in other way
inadmissible contents, and will not be held accountable for such content.
Should such unsuitable
content be present, users are requested to inform PokerStrategy so that
PokerStrategy is able to check for and remove it.
In case a legal issue
concerning PokerStrategy or specific contents on www.pokerstrategy.com arises, please
inform PokerStrategy through an informal Email addressed to support@pokerstrategy.com. With this any compensation claims of the person
issuing the warning are negated.
10.
Copyright
Articles, text and images as well as their arrangement are copyrighted. Users
are allowed to make use of the contents found on the platform only for their
own personal use. Without written agreement from PokerStrategy the user is not
allowed to circulate, present, make publicly accessible, publish or link to
this content.
11.
Tell-a-Friend
System
Within the Tell a Friend
(TaF) system, PokerStrategy may pay a premium for new recruited customers after
performing its own assessment. The user is allowed to collect this premium only
after its value has exceeded US$50. The
possibility to claim the collected premium expires 6 months after reaching the
US$50 point or after the last increase.
12. Shop
The online shop found on www.pokerstrategy.com is operated and
maintained by the X-tra Trade and Communication GmbH under the general terms
and conditions located on the shop page.
13. Final Provisions
A
registered user takes part in the newsletter system. The user is able to
unsubscribe from this newsletter at any point, through their profile. The
intervals in which the PokerStrategy newsletters are sent can vary in time.
PokerStrategy
is authorized to transfer all or a portion of their services to a third party
system at any time. The user will be informed via the platform should such a
situation occur.
